Donald Trump Controversy : First US President to be impeached twice
Joe Biden wins and becomes the new President of the United States (US), after defeating the ex-President Donald Trump.
However, Donald Trump is accused of inciting his supporters to commit violence inside and outside the US Parliament. Five people, including a police officer and a woman were killed in it. He was then impeached. He is the first US President to be impeached twice. Earlier, he was impeached in 2019 but escaped. This time, if he was found guilty, then he would not be able to contest in 2024 US Presidential elections.
Now, what does this ‘impeachment’ mean?
Impeachment means removal from an officiating post.
How impeachment is achieved?
Procedure for impeachment of President of India –
In India, there are two Houses of Parliament –
- Rajya Sabha
- Lok Sabha
The President of India can be removed from his post/ office by a process called Impeachment. Impeachment is done if the President is found to be involved in “Violation of Constitution”. The impeachment charges can be initiated by either house of the Parliament – Rajya Sabha or Lok Sabha. If one house frames the impeachment charges, then the other house investigates them.
If one house initiated impeachment charges, then these charges should be passed by at least two-thirds members of that house and a notice is prepared to send to the President which is to be signed by at least one-fourth members of that house. A time of 14 days is to be given for the notice, before starting any further action.
After the expiry of 14 days, the impeachment charges are sent to the other house for further investigation. The President has the right to appear in that house in his defence.
If the other house also passes impeachment charges by at least two-thirds members of that house; then the President is impeached on the same day.
Procedure for impeachment of President of US –
In the United States (US), there are two houses –
- House of Representatives
The President of the US can be removed from his post/ office by a process called Impeachment. Impeachment is done if the President is found to be guilty of “treason, bribery or other high crimes or misdemeanors”. The impeachment charges can be initiated by the House of Representatives and the Senate investigates them.
If the House of Representatives initiates the impeachment charges, then these charges should be supported by a majority of at least 51%. After this, the process moves to trial.
The Senate investigates these charges. The members of the Senate act as the jury. The president has the right to appear in the Senate in his defence. He may also bring in his lawyer along with him. After the completion of the investigation, the Senate declares his decision, which should be supported by a majority of at least 67%. If this happens, then the President is impeached on the same day.
